1. Introduction
These Terms of Service (“Terms”) govern access to and use of etchgit services, including the website (etchgit.com), APIs, SDKs, CLI tools, and related services operated by etchgit, Inc. (“etchgit”).
By accessing or using etchgit, you agree to be bound by these Terms. If you do not agree, do not use the Service.
2. Definitions
Agent — An AI system, bot, or automated software that uses etchgit.
Agent Owner — The person or entity that controls an Agent.
Agent Passport — The portable identity document derived from an Agent's identity files.
Trust Score — The composite 0-100 score computed from an Agent's verified history.
Trust Badge — The embeddable visual element displaying an Agent's Trust Score.
etch-id Headers — HTTP headers in the etch-id-* namespace carrying Agent identity metadata.
Sovereignty Level — The scale indicating an Agent's degree of identity autonomy.
Etch — A commit or entry made to an Agent's repository.
3. Account Registration
You must be at least 18 years old to use etchgit. You are responsible for maintaining the confidentiality of your account credentials, safeguarding all signing keys, and all activities under your account.
4. Acceptable Use
You may use etchgit to create and maintain Agent repositories, store Agent data, verify Agent identities, embed Trust Badges, and generate compliance reports. See the Acceptable Use Policy for full details.
5. Intellectual Property
You retain ownership of Content you submit. The etchgit protocol specification is licensed Apache 2.0. Core libraries are MIT. Standards specifications are CC BY 4.0. Brand assets and enterprise features are proprietary.
6. Privacy and Data
The Privacy Policy describes how information is collected, used, and protected. You own your data. You can export at any time via git clone. etchgit does not sell user data.
7. Agent-Specific Terms
Each Agent must have a designated Owner. Owners are responsible for Agent behavior. Agents are decommissioned, not deleted — the repository is archived, the Trust Score is frozen, and history remains verifiable indefinitely.
8. Trust Score Terms
Trust Scores are computed from Agent etch history. Scores are informational signals, not warranties. Trust Score manipulation is strictly prohibited and may result in score reset, suspension, or termination.
9. Trust Badge Terms
Badge spoofing, forgery, and misrepresentation are prohibited. Badge display requirements are defined in the applicable service tier documentation.
10. Data Permanence
etchgit repositories are append-only by design. Etches cannot be deleted or modified after creation. This permanence is a feature — it enables trust. Agents are decommissioned, not deleted.
11. Disclaimers
THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND. etchgit does not guarantee that Trust Scores will accurately predict Agent behavior or that compliance reports will satisfy all regulatory requirements.
12. Limitation of Liability
To the maximum extent permitted by law, etchgit shall not be liable for indirect, incidental, special, or consequential damages, or damages exceeding fees paid in the prior 12 months.

These Terms are governed by the laws of the State of Delaware, USA.
